There have been many years of restrictions and sanctions for a very marked sector of the driving population. And the fact is that, a simple mistake caused many drivers to lose their jobs and be severely sanctioned more than a decade ago! And since then they have not been able to put a foot on the pedal because they were severely punished. Now, after many years of restrictions and sanctions, hundreds of drivers in Massachusetts are finally seeing a little light at the end of the tunnel and will be able to recover their driving licenses thanks to a new legislative reform. Perhaps the damage can no longer be repaired, but we can move towards a future where mistakes are paid for only once and not for life. We will tell you about it below!

The origin of the problem

It all goes back to 2005, when the so-called Melanie’s Law was approved, a regulation that toughened the punishments for those drivers who drove while intoxicated. It is logical that these users should be punished because they compromise the safety of all users, but ten years of punishment? Surely they have already learned the lesson that drunk driving is prohibited.

Who was Melanie Powell?

A young girl who died after being run over by a drunk driver in 2003. This set off alarm bells throughout society, which is why they proposed Melanie’s Law, to punish those users who put the safety of any citizen at risk by driving drunk, refusing to take a breathalyser test or fleeing the scene of an accident.

So what is the problem?

The problem is that while the law has been in place for years, it wasn’t until 2019 that the state’s Registry of Motor Vehicles (RMV) began using it strictly, retroactively revoking licenses. Within weeks, about 500 drivers were left without their driving permits, losing their livelihoods regardless of whether their violations occurred more than 15 or 20 years ago.

Mike McDonald, an affected driver, said in an interview that after 17 years of working as a trucker, the suspension of his license left him without income overnight.

What will this new law do?

The proposed law is a key amendment to Melanie’s Law, because instead of applying lifelong penalties, only the past 10 years of driving records will be taken into account, and those drivers who committed an infraction of this type more than a decade ago will be able to get their license back and drive again.

In addition, after its approval, it will come into effect immediately to minimize the damage that may have been caused in terms of work and personal life to these people.

According to lawyer Brian Simoneau, who represents several affected drivers, the measure seeks to do justice, since the disqualifications applied recently do not correspond to the seriousness of the crime today.

When will it go into effect?

If there are no objections, the law could be approved in the next few weeks and sent to the governor for his signature. Once signed, it would be applied immediately and these affected people would be able to drive legally.

It should be noted that this measure is not promoting drunk driving, not at all, it only seeks to correct past mistakes and put the focus of the debate on the need to update the laws so that they can be adjusted to reality as best as possible.

Adapting to the current reality is necessary for everyone, but the question now is whether it will be enough to repair the damage caused to those who lost their jobs due to this measure.
